Why Is Clearance Separate From Filing?

The filing package includes a limited preliminary review designed to identify readily apparent conflicts or filing concerns before an application is submitted. It is not a comprehensive trademark clearance search.

A comprehensive clearance review goes further. It is designed to assess the broader risk of adopting, using, investing in, and seeking registration of a mark, including risks presented by relevant federal registrations and applications, common-law uses, and marketplace activity.

Depending on the mark, industry, and level of investment involved, Rechtszaid Law may recommend comprehensive clearance before filing.

If the USPTO Issues an Office Action

Not every Office Action requires the same amount of work.

The $1,400 filing package includes up to one non-substantive Office Action response, such as addressing certain technical or administrative issues.

Substantive Office Action responses are outside the scope of the flat fee. These may include refusals involving:

  • Likelihood of confusion with another trademark
  • Descriptiveness
  • Genericness
  • Failure to function as a trademark
  • Other substantive legal issues

If a substantive Office Action is issued, Rechtszaid Law will review the refusal with the client, discuss the available options, and provide the scope and cost of any proposed response before additional work is undertaken.

Unless expressly included above, the flat fees do not include:

  • USPTO filing fees
  • Third-party trademark search costs
  • Additional classes beyond those included
  • Substantive Office Action responses
  • Statements of Use
  • Extensions of time to file a Statement of Use
  • Appeals
  • Oppositions or cancellation proceedings
  • Enforcement matters
